Rules for the "Rock Day Cultural Contest"
WIKIMETAL PORTAL DE INTERNET E SERVIÇOS ARTÍSTICOS LTDA-ME (“WIKIMETAL”), located at Rua Bernardino de Campos, 277 – Centro in the city of Indaiatuba/SP, registered with CNPJ under number 15.565.819/0001-73, promotes this Cultural Contest in partnership with SARAIVA EDUCAÇÃO SA (“BENVIRÁ”), located at Avenida das Nações Unidas, 7221, 1st floor – Pinheiros, São Paulo/SP, with the objective of offering entertainment and stimulating the creativity of the participants.
PARTICIPATION
1.1 All individuals domiciled in Brazil are eligible to participate in the Contest, excluding agents with management functions, partners, directors, executives, and employees of WIKIMETAL and SARAIVA EDUCAÇÃO. In addition, any person or employee of an organization that is directly or indirectly involved in any aspect of this Contest may not participate.
VALIDITY PERIOD
2.1 The Contest will begin on June 27, 2017 and end at 11:59 PM on July 11, 2017, and may be extended at the sole discretion of WIKIMETAL or SARAIVA EDUCAÇÃO.
DISCLOSURE
3.1 The contest and its dynamics will be publicized on Social Networks (Facebook/Twitter/Youtube) and official internet pages of WIKIMETAL and BENVIRÁ.
CONTEST DYNAMICS
4.1 To participate in the contest, participants must, during the validity period, create a sentence answering "What would you do to win a kit with the biographies of the main rock stars?", either through the promotion's landing page or by sending it to the email address [email protected] . Participants may only participate once per email address, which will be the means of contact to arrange the delivery of the prize.
4.2 The phrase or text must be entirely original and relevant to the Contest theme.
4.3 The content of the material is the sole and exclusive responsibility of the participant, who must respect Brazilian laws. A phrase containing citations of existing creations will not be disqualified, but the judging will follow the criteria indicated in item 5.1 of these Regulations.
4.4 All entries will be moderated to verify compliance with the terms of these rules. Phrases or texts deemed inappropriate will be removed from the contest without any need for notification to the participant. In case of repeated submission of inappropriate phrases or texts, the participant is subject to cancellation of their participation in the contest.
4.5 The phrases or texts submitted are intended to promote cultural context. By submitting them, the participant agrees to the legal terms for the transfer of copyright contained therein, allowing WIKIMETAL and Benvirá to use them on Social Networks and the Official Website (and any other communication) for a period of 5 (five) years throughout the national territory, without any monetary compensation being due to the participant.
EVALUATION CRITERIA
5.1 The phrases or texts will be judged by the Competition Committee, based on (i) Creativity; (ii) Originality; (iii) Suitability to the Competition theme.
5.2 The phrases or texts must be created by the participant themselves and must be in accordance with the contest theme. Participants must own all copyrights to the material they submit to WIKIMETAL and Benvirá.
5.3 Any entry that, in the opinion of the Contest Committee, is considered inappropriate, will be automatically disqualified without notice to the participant. WIKIMETAL and Benvirá are not responsible for entries submitted that contain third-party rights.
5.4 The judging committee will have absolute authority and discretion in selecting the winners, and its decision will be final and unappealable. By participating in this contest, participants expressly waive any right to question the criteria adopted, with the criteria of the WIKIMETAL and Benvirá judging committee always prevailing.
5.5 If more than one participant submits an identical phrase or text, the tiebreaker will be determined based on the date and time the email was sent.
AWARDS, PROMOTION AND DELIVERY METHOD
6.1 The winner of the contest will receive a kit containing biographical works of international rock stars and bands listed below, as well as a voucher to give to a friend registered on the promotion's landing page or indicated in the body of the email sent for participation – who may choose three of the literary works included in the kit:

Trust me, I am Dr. Ozzy;
Mustaine;
Nothin' to Lose – Kiss);
Rocks – Joe Perry;
How rock can help you succeed;
Does the noise in my head bother you? – Steve Tyler;

The prizes offered are non-transferable and cannot be exchanged for cash. No prize substitutions will be allowed, except in cases where this becomes necessary for justifiable reasons or reasons beyond the control of WIKIMETAL and Benvirá.
The kit may contain other titles not mentioned in these regulations, depending on Benvirá's stock availability.
The winner of the voucher will choose the books by contacting Benvirá via email, and Benvirá will send an updated list based on stock availability at the time of purchase.
6.2 The winners of the Cultural Contest will be determined by the Contest Committee at the WIKIMETAL headquarters, and the final result will be announced on July 13, 2017, through social media (Facebook/Twitter/YouTube) and the official WIKIMETAL website.
Results can also be viewed on Benvirá's digital channels.
6.3 The winner(s) will be notified by WIKIMETAL or Benvirá, who will provide instructions for receiving the prize.
Loss of entitlement to the prize.
7.1 The winning participant(s) who do not claim the prize or respond to contact within the time stipulated in these rules will forfeit the right to receive the prize, and WIKIMETAL and Benvirá will have the exclusive right to award the prize to another participant.
7.2 The participant(s) declare that they are aware of the characteristics of the prize and that untimely withdrawal will prevent them from enjoying the prize due to its nature.
DISQUALIFICATION
8.1 Participants who: will be immediately disqualified from this Cultural Contest.
Failure to comply with any condition of the regulations;
Committing an illegal or illicit act, or an act that violates the objectives and rules of the Contest;
Submitting entries containing content about alcoholic beverages, cigarettes, drugs, nudity, pornography (including child pornography), that are against the law, impute the commission of a crime, offend morality or good customs, or that have offensive connotations to third parties;
Using systems, software, and other automatic, repetitive, or programmed tools or methods that create conditions for sending entries [reports], browsing, participating, or voting that are considered by the Contest Committee to be irregular, unfair practices, or practices that violate the recreational objectives of this Contest. The Contest Committee may, at its discretion, suspend or exclude the participant in the case of suspicion or evidence that they have used such artifice without prior notice.

GENERAL PROVISIONS
10.1 By sending an email for this Cultural Contest or filling out the promotion's Landing Page, the participant tacitly declares that they agree to all the terms of these Regulations and unconditionally authorizes, in the event of being awarded a prize, WIKIMETAL and Benvirá to freely and gratuitously use their name, voice and image for advertising and promotional campaigns related to the Contest, throughout the national territory, for a period of 05 (five) years from the date of the award.
10.2 Participants in this Contest definitively, freely, irrevocably and unretractably assign all their copyright to the creation of the phrases or texts [stories] submitted for commercial or non-commercial, advertising, promotional and/or institutional use by WIKIMETAL and Benvirá, for dissemination through any form or means.
10.3 Access to and access conditions (type of hardware, software, provider, connection and other conditions) of this recreational contest website are the sole responsibility of the participant. WIKIMETAL and Benvirá are not responsible for access and means of sending emails or filling in data on the landing page, nor do they guarantee that access to the official website and social networks of WIKIMETAL or Benvirá will be free from interruptions, interventions or suspensions caused by unforeseen events, internal or external, force majeure or other events not entirely subject to their control, therefore exempting themselves from any liability arising from such facts or acts.
10.4 Any and all situations not foreseen in these Regulations, as well as any omissions, will be decided exclusively by the Competition Committee of WIKIMETAL and Benvirá.
10.5 The Committee reserves the right, at its sole discretion, to change the terms of these Regulations, informing the participants of this Contest in advance and always seeking to ensure its legality without prejudice to its participants.
10.6 The selection and acquisition of prizes or any other obligation of WIKIMETAL and Benvirá will be carried out at their sole discretion, and subject to the provisions and limits of these regulations.
10.7 The distribution of prizes in this Cultural Contest falls under the category of Cultural Contest, which is exempt from authorization by CEF, under the terms of articles 3, item II, of Law No. 5.768/1971 and article 30 of Decree No. 70.951/72, since the purpose of the Cultural Contest is strictly recreational and not subject to any form of chance, risk, purchase of the product or payment by the participants.
10.8 The jurisdiction of the District of Indaiatuba, State of São Paulo, is chosen to settle any issues that may arise from this regulation.
