After months of legal battle between Spencer Elden and Nirvana , the lawsuit involving the cover photo of the album Nevermind has been dismissed.
In August, Elden, best known for being the famous naked baby who appears on Nirvana's legendary album cover, filed a lawsuit against the band alleging that the image constitutes "child pornography" and "sexual exploitation."
Despite several attempts to add evidence to the case, including citing passages from Kurt Cobain , the case was dismissed by Judge Fernando M. Olguin weeks after Nirvana responded legally to Spencer , alleging that he had "benefited for three decades" from his fame as the baby of Nevermind .
Spencer Elden and his lawyers have until January 13th to appeal the case and file a new complaint with amended text. If they miss the deadline, the case will be dismissed for this reason.
