'Nevermind' case: Spencer Elden appeals court decision and files amendment in lawsuit.

The famous "Nirvana baby" sued the band for using his image on the cover of 'Nevermind'.

After having his case dismissed , Spencer Elden appealed the case Nevermind cover photograph . Elden is the famous baby in the legendary photo and in August he filed a lawsuit against Nirvana for "child pornography" and "sexual exploitation" of his image.

On January 4th, a judge dismissed the case, but allowed Elden to appeal the decision as long as he added new details to the proceedings. 

In the new amendment, Spencer accuses Nirvana of "intentionally commercializing child pornography depicting [him] and leveraging the lewd nature of his image to promote the album Nevermind , the band, and Nirvana's music, while earning at least ten million dollars in total."

This new version of the lawsuit omitted an initial accusation that Nirvana was involved in "sex trafficking" by selling the cover photo.
